In China, our main headquarters is in Shanghai, where you will be based out of.

 

Your role:

 

Leading a team of talented legal professionals operating with the highest standards of integrity, focused on providing effective legal support for the achievement of company’s goals and objectives under the supervision of the Company’s APAC VP Legal.

 

Some of the key responsibilities include (and are not necessarily limited to):

 

  • Acting as an advisor and counsellor to the country’s CCE and CFE and maintaining regular and frequent interactions.
  • Providing timely and regular updates to the Company’s APAC VP Legal, especially on issues of potential as well as actual risk and foreshadowing possible detrimental outcomes or potential exposures
  • Mentoring and developing the legal team – tailoring plans and objectives for each team member to develop each person’s strengths and address any areas in need of development. With the overall aim of improving the skillset of the team as a whole and of the individuals – to have the effect of improving the team’s effectiveness in meeting the needs of the Company.
  • Providing clear, concise, and practical legal advice regarding day-to-day operational matters and transactions – in addition to extraordinary matters and issues as they arise.
  • Identifying areas of legal risk and working with the business to assess the impacts of commercial risk – to help formulate business cases which (to the extent possible) improve the Company’s rewards, whilst mitigating risk.
  • Effective collaboration across functions and with the business, to devise solutions and/or effective risk mitigation strategies – whilst maintaining the Company’s (and its Officers) compliance with all laws and with the Company’s policies and Code of Conduct
  • Maintaining an active and ongoing engagement with business and functional leaders to help identify areas for improvement and help streamline processes
  • Contribute to business decision making and actively participating as a member of the country’s Executive Leadership Team.
  • Safeguarding the Company’s interests and helping to maintain the Company’s standing as a good corporate citizen, both as legal entities and with respect to the discharge of the duties of the Company’s Officers
    • In achieving the best results obtainable in all the Company’s affairs and in its commitments
    • Preserving, protecting (and where necessary, enforcing) against breaches of commitments made to the Company
    • Operating with the highest standards of integrity and trustworthiness
    • Providing regular and comprehensive functional reporting
    • Appropriately escalating potential issues of significance and importance, at the earliest possible time
  • Managing assigned projects to achieve their optimal execution and delivery
  • Preparing and reviewing contracts, lead, participate and/or support negotiations.
  • Helping to prevent or resolve disputes, assess the company’s legal position, develop case strategies, formulating acceptable alternatives for resolution.
  • Selecting, engaging, managing, and monitoring outside counsel, to ensure the Company obtains the best value for its outside legal spend
  • Being solutions-oriented in the approach to problems, whilst knowing and educating others on lines and boundaries which cannot be crossed.

 

What you bring to the role:

 

Education:

 

Bachelor’s degree in law with an appropriately accredited university

 

Experience:

 

PRC Bar admission in good standing with 10 + post qualification experience

US Bar admission in addition to PRC Bar (desirable)

Having previously managed a team of legal professionals

Excellent communication skills (both oral and written) in both Chinese and English

Proven ability to interact with people at all levels both within and outside PRC.

Understanding of FCPA and other relevant US laws and compliance requirements applicable to the subsidiary of any US-owned company.

Verification of all academic qualifications, professional memberships, reference, and any other background checks resulting satisfactorily.
